Erfpacht in Utrecht: what is left after the conversion window closed
Utrecht stopped selling the ground under leasehold homes in September 2025. What a buyer inherits, how the 2017 buy off scheme prices the canon, the exceptions.

For seven years a Utrecht homeowner on municipal ground could simply buy it. That door closed on 25 September 2025, and a buyer now takes over whatever the previous owner did or did not do before it shut.
Erfpacht in Utrecht comes in three kinds, perpetual, continuing and temporary, and the deed of delivery says which one applies. Since September 2025 the ground can only be bought in a handful of cases, but the 2017 buy off scheme still lets an owner occupier fix or pay off the canon at a land value derived from the WOZ value.
Which kind of erfpacht does the house have?
The municipality's page for private owners distinguishes three kinds. Perpetual erfpacht runs forever, with either no canon or a fixed annual canon that can be bought off. Continuing erfpacht runs for an indefinite period, and after a 50 year period the municipality may adjust the conditions. Temporary erfpacht has an end date. Under a running canon the owner pays yearly or half yearly, and the municipality may adjust the amount periodically, usually once every ten years. Which kind applies is stated in the deed of delivery, and the city points buyers to the seller, the agent or the notary for that information.
Can the ground still be bought?
Rarely. The city's conversion page records that leaseholders could buy the bare ownership until 26 September 2024, that a transitional scheme ran until 25 September 2025, and that conversion is now possible only in specific cases. Apartment owners can still apply, but only collectively with the owners' association and with the perpetual canon bought off, with a deadline of 26 September 2026 and delivery at the notary within a year. Holders of rights under the 1974 and 1983 general terms get a one year window after the council approves revised terms, and must file the canon buy off request at the same time. The municipal executive can allow other cases in exceptional circumstances, and homes in the former municipality of Vleuten-De Meern keep their own route. The city's questions page puts the administration cost of a conversion at 925 euros, or 825 euros when the conversion is combined with the buy off scheme, on top of the notary.
How does the 2017 buy off scheme price the canon?
The Conversieregeling Erfpacht 2017, open since 1 April 2018, is explained on the city's buy off explanation page. It applies to temporary and continuing erfpacht where the owner lives in the home and the use is exclusively residential. The land value is derived from the WOZ value through a table of land quotas, with lower quotas for apartments than for single family houses, and discounted at 5 percent a year to a present value. The total buy off sum is the sum for the land plus the sum for the canon, and can never exceed the land value derived from the WOZ value.
The buy off page lists three ways to settle it: pay the whole sum at once, fix the sum and pay an annual canon of 5 percent of it in half yearly instalments, or pay part now and 5 percent on the remainder until the rest is paid. The municipality first assesses eligibility, then sends an offer with the costs and next steps, which usually takes a few weeks, and the outcome is recorded in a new agreement or a notarial deed at the applicant's expense.
What does a buyer actually inherit?
The state the seller left the right in. A fixed sum under option two travels with the home as an annual 5 percent canon, a bought off right travels as a right without canon, and an untouched continuing right travels with its next 50 year revision and its ten yearly canon adjustments. None of it is visible in the asking price, all of it is in the deed of delivery.
